We have a Human Rights Act (2019) which must be used by decision-making statutory agencies such as local governments. As a community advocate I have found our local government fails to meet this obligation. The council took a bogus complaint against a street library and forced it off the front footpath despite our claim that according to their by-law they must investigate whether the complaint was vexacious. Council did not give us a copy of the complaint. We had to pay under RTI. WE eventually were able to identify the complainant and that their complaint was bogus. The Council passed our second complaint against their action and inadequate response and our second Rti request to external solicitors. This ensured we had not further RTI access. After many months the council rescinded their compliance notice.
What has to happen for citizens to make governments accountable for doing what legislation prescribes. We have no legal support. This is a substantial barrier to natural justice?
